Hey Guys,

I took my SMG M3 '03 to a local european repair shop today to replace my old brake pads with some Axxis brake pads I had found online. The specialist who drove my car in the shop mentioned a chuttering/bucking i'd been having in 1st gear for a couple of days now. I told him I was aware of the situation and I looking to have it fixed shortly; and that if he happened to see anything unusual today to let me know... he replied no problem

After about two hours he called and told me that my clutch burned out and the car refused to engage in gear!!

My car was running fine, it just bucked a little in 1st. I was so enraged with disbelief that I told them to take me to the car immediately so I can see this with my own eyes. I got inside the car and attempted to start it up, but it wouldn't crank up. I turned the key, the zero would flash, but still nothing. The ONLY warning light lit before I came was the brake sensors but now that was gone and (the light farthest to the right is lit in yellow & the "service engine soon") were both on. THIS IS INSANE I thought. I looked around like whats going on? And although there was a lot of speculation nobody could tell me exactly why my car was able to crank when i came in but now it could not.

After about three more hours they said they were able to crank the car and therefore prove that without replacing the clutch the car would not move. He then placed a magnet underneath the car near the clutch, as the car was lifted, then another mechanic in the car cranked it and it started. The car was making a loud squealing noise and smoke began trickeling down by the clutch so I told them to turn it back off before the car even came down the lift.

So what I did next was have my car towed to the Stealership. My car does not run. Im going to have them fix it and send these guys the bill. I told the BMW techs to investigate any proof that mechanical tampering took place... I should hear back tomorrow

Aren't M3's managed like computers?? Well I'd never put a magnet near a computer! Do you know any damages that could surface as a result?

I'd also like to hear what you'd do if you were in my position.

when u unlock the car u should hear the SMG pump. if u dont hear that more than likely thats gone.
but for the clutch to burn out is hard to believe especially on an SMG. unless u have been using "launch control" every single light.

so many people are confused on how to work the SMG as far as starting it, and then putting it in gear when they first encounter it for some reason.

id be p!ssed and would sue if they refused to pay if the BMW dealer told me someone messed it up.

how can you bring your car perfect to them then they suddenly burn your clutch out, this is BS. Make sure they pay for all the repairs. either that or tell them you are going to sue them.

Wow...interesting - lets us know what happens and what the stealers end up finding out about your car.

UPDATE-

SHOCKER

Stealership called back today and reported that the my car key reads a 4 mile difference from the odometer in the car... In conclusion, they took the car for joy ride and probably destroyed the clutch using launch control... The tech that I spoke to said its fair to assume they attempted to retract the mileage with the computer software they had at the shop
... but there was no way (or atleast they were not aware of a way) for them to change the mileage on the key

Tomorrow, I plan to present the statement from the BMW tech on a BMW Dealership letterhead to this organization with an estimate for the repairs; to give them the opportunity to settle everything out of court.

$2,600 in damages

If they decline to pay for the repairs then i'll file a civil suit or mechanical lein against them.

At this point there is enough evidence for justice to be served.

SBD, keep us apprised of the situation. And let us know who this scumbag is now that you have proof of tampering. We should all know who to avoid in the future. Or keep their name quiet for now to use later should they not agree to pay for the repairs. Who knows how damaging publicity can be to their business, especially if they are a Euro shop.

I'd take a second opinion and based on the outcome name either name an shame or put right the problem an trust the current vendor you picked = did they come recommended?

4 miles rack up quick tho.. could those 4 just add up from having the car in neutral and while it free rolls (like pushing the car without a car).. is there a way to tell when those miles accrued?
i still think they did it!! sue the hell out of them.

although 4 miles isnt THAT much 4 miles adding up from rolling a car around a shop in a day is out of question i think.

OP if you gave that shop the OK to "test drive" the car then you may not have a case...honestly i cant stand idiot shops like this who think its fun to take the customers car for a joy ride then blame the damages on YOU. thats why i take my car to only two well trusted shops and i know the ppl there personally or else this kind of stuff happens...best of luck to you reading about these stupid shops gets me so upset.

So whats the story, have you confronted the mechanic shop?? What did they tell you??

Quick Update-

I stopped by the BMW dealership today to pick up the statement from the tech. This is the first time I've spoken to him face to face. He apparently did not want to be involved legally and had not yet written the statement. I explained that the information he expressed was very important for the case im building. He eventually agreed to under the condition that his name be withheld from all documentation.

This kind of threw a wrench in my plan to confront the shop today. I have some suspicion that the company may have had some sort of contact with bmw or know someone in there but I can only assume that.

I live in Brooklyn but this is all taking place in Tallahassee, Florida; where im currently attending school.

Im picking up the "anonymous" statement from BMW today @ 5 (after my last class).

I have a consultation with my attorney scheduled early tomorrow morning. Im not sure if the statement is any less useful since its anonymous but I should have all my concerns addressed tomorrow

this kind of stuff is why I wont let anyone else work on my cars - i know others are not able or have the facilities...so no bashing here - good luck

Thats the reason i hate taking my car to the mechanics they fix one thing and set up another. I knew a guy that was a mechanic and he said they use to put extra oil on oil changes so they mess up the car and they come back to fix the gasket or whatever extra oil damages.

i totally agree. but i was thinking previous owners and lifetime rolling around.. i was just talking i guess.
i hate that this happened. i think its so BS that u can go in with 1 single problem and come out with one hundred. UGHH!!! nuke the shop FTW.

Update-

The shop declined to pick up the bill after I confronted them with the statement from BMW.

I spoke to my attorney today and he gave me "step-by-step" instructions on how to file for the civil suit.

Every document involved with this situation was faxed to my attorney for his review.

Then, I headed down to the courthouse to fill out the necessary paperwork.

For now, everything I could possibly do is done.

The courthouse told me i'd recieve my official court date in the mail.
