Are xenons that don't auto level illegal?

No, they're not illegal. In fact, many factory HID systems do not have auto-leveling (mostly Japanese cars).

I believe they are illegal. or say.. over a certain K it is illegal.

I've been blinded by some rice cars without auto leveling.. I hate it!

that some japanses cars dont have auto level and they are legal, but BMW's without auto level are illegal. That's why Bekkers sells their oem kits with a note that says intended for off road use or something. Also I am pretty sure that anything over 4300k is illegal.

The BMW Xenons use a projector lens assembly that focuses the light in a specific area- and this must be below the eyes of on-coming drivers- This is why you must have levelling- if you have a couple of dead bodies in your trunk- your headlights will blind on-coming motorists-

The Japenese cars that have Xenon lights do not use projector assemblies- the lights are using a normal reflector / bulb-cover arrangement- Their light output is less that the projection housings, and less focused.

it is illegal to not have auto leveling in EUROPE but legal in JAPAN.
