CEL & Tran ! on, Dealer sugg. DME update?

Guys,

Recently I ran out of gas at the pump. After I filled it up my CEL came on along with the tranny ! inbetween the gear selection. I brought it to the dealer for diagnostics and they said it was a problem with the DME. They said they needed to update the software and the problem should be fixed.

Now why is that the car ran fine right before i ran out of gas, then when i filled up, the car is in limp mode with and tranny is shiffting hard. Why would it need to be updated?

Not sure, but running you car out of gas is hard on the fuel pump. When my pump went out (with half a tank of gas), nearly every light on the dash turned on.

I do not think it is the fuel pump only because i have put about 75 miles on the car like this between driving home from work that day and back and forth from the dealer.

I am out of warrenty and have to pay each time i go up there so i wanted to make sure this is at least a viable opinion

An update on my situation. After replacing my crankshaft sensor the problem was still present. I brought it to the dealer again for diagnostics. The reprogrammed the DME with new software and boom, back to normal. Car is very strong and very smooth. Tully BMW in Nashua, NH is very plesent to deal with
